UK Immigration Update: New Immigration Rule Changes Affect Graduate Visa Holders and Families

The Home Office has published a new Statement of Changes to the Immigration Rules, introducing amendments to the Graduate Route, Appendix FM and Part 8 of the Immigration Rules. Most of these changes are expected to take effect from 3 August 2026 and are designed to address practical issues affecting families already living in the UK.

Key Change: UK-born Children of Graduate Visa Holders

One of the most welcome changes concerns children born in the UK to parents who hold permission under the Graduate Route.

Previously, the Immigration Rules did not provide a clear route for a child born in the UK during a parent’s Graduate Visa to apply for permission as that parent’s dependant. This created uncertainty and often required families to seek alternative immigration solutions.

Under the new rules, eligible children born in the UK while a parent holds Graduate Route permission will now be able to apply for leave as a dependant under the Graduate Route. This closes an important gap in the Immigration Rules and provides greater certainty for international graduates raising families in the UK. (House of Commons Library)

Changes to Appendix FM and Part 8

The Statement of Changes also makes amendments to Appendix FM and Part 8 (Family Members). These changes are largely technical and ensure consistency across the Immigration Rules, particularly in relation to family applications involving Graduate Visa holders.
