Being on immigration bail can affect your options, but it does not always prevent a successful application from within the UK.
Changes introduced on 3 August 2026 mean that, under many immigration routes, bail alone should not lead to refusal where the applicant meets the relevant exceptions for overstayers.
You must still satisfy the other requirements of your chosen route. This change does not automatically give you permission to stay.

The 14-Day Overstayer Exception: What You Need to Know
Have you missed your visa expiry date? Do not assume you have an automatic 14-day grace period.
One exception may apply where you submit an application within 14 days of your permission expiring and show a good reason beyond your or your representative’s control for the delay. Separate provisions can apply following certain refusals or the end of section 3C leave.
The dates and evidence matter.

Does a Late Visa Application Restore Your Right to Work?
Submitting a visa application after your permission has expired does not, by itself, restore your previous right to work.
Even where an overstayer exception applies, a late application does not create section 3C leave or reinstate your previous visa conditions. You would need another lawful basis to work while awaiting a decision.

On Immigration Bail and Considering a Skilled Worker Visa?
A Certificate of Sponsorship is an important requirement, but it does not resolve every immigration issue.
Under the amended Skilled Worker Rules, an applicant on immigration bail may avoid refusal on that ground if the relevant overstayer exception applies. They must still meet the remaining requirements, including those concerning sponsorship, salary and English language.
Your immigration history and application dates need careful assessment.
